BACKGROUND
On May 6, 2019, the Village Board approved Ordinance 5586 (2019-0083), establishing the three-lot subdivision known as Peony Place Subdivision. All three lots in the subdivision are single-family detached residential dwellings with detached garages in the rear. The ordinance granted variances to increase the maximum lot width for Lots 1 & 2 from 50’ to 62.5’ and waive the requirement to install a public sidewalk along the east side of Second Avenue and the west side of Third Avenue.
On March 7, 2022, the Village Board approved a re-subdivision of Peony Place to subdivide the original Lots 1 & 2 into 3 lots, creating 3 lots that met the requirements of the Old Orland Historic District and eliminated the need for the variances that were previously granted (2021-0378).
On June 8, 2022, a Certificate of Appropriateness was approved for the construction of a new single-family dwelling with a detached garage for Lot 2 of the Lawler Re-Subdivision of Peony Place (2021-0835).
On May 10, 2024, a Certificate of Appropriateness was approved for the construction of 2 free-floating decks (2024-0364).
PROJECT DESCRIPTION & CONTEXT
The petitioner is proposing to construct a new vinyl fence and a garbage pad on their property at 14420 Third Avenue. The property is an interior lot, and the fence is proposed to connect to new fencing proposed at the neighboring property at 14414 Third Avenue (2026-0384). A Certificate of Appropriateness is required for all new and replacement fences in the Old Orland Historic District, which is reviewed administratively.
Per Section 6-209. of the Land Development Code (LDC), in the Old Orland Historic District, fences shall not exceed a height of 5-feet. Chain link fences are not permitted. Fencing on property with non-contributing structures or new construction can be vinyl. (Ord. 4738, 6/18/12).
The proposed fence is white 4’tall picket fencing in the style Bridgeport Flat Top from America’s Backyard Products. The fence will be located around the perimeter of the site, connecting to the neighbor’s fence to the north at 14414 Third Avenue. The finished side of the fence shall face neighboring residential properties as applicable.
Per Section 6-302 of the LDC, the proposed garbage pad is to be considered as general flatwork and shall therefore comply with all flatwork requirements. It is proposed at 4’ wide and 8’ long, adjacent to the detached garage. It will be setback at least 1 foot off of the property line. The proposed location has been approved by Engineering staff.
Overall, the project conforms to the Village’s Comprehensive Plan, Land Development Code and policies for this area.
Recommended Action/Motion
