ORDINANCE OF THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF ORLAND PARK VACATING PARTS OF THE RIGHT-OF-WAY (142ND STREET AND CRESCENT PARK CIRCLE)

 

Body

WHEREAS, there is property at 142nd Street and at 142nd Street and Crescent Park Circle in the Village that is a dedicated but unimproved right-of-way; and

 

WHEREAS, the Village Board has determined that the said dedicated but unimproved right-of-way will never be improved and is willing to vacate said right-of-way; and

 

WHEREAS, the Village is the owner of the property (the “Owner”) lying immediately adjacent to the right-of-way to be vacated; and

 

WHEREAS, the Village Board of Trustees of the Village of Orland Park has determined that such vacation is in the best interest of the Village; and

 

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Village Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The recitals set forth above are hereby incorporated in this ordinance.

 

SECTION 2

 

The Village Board of Trustees of the Village of Orland Park hereby vacates that parcel of land legally described below and shown on the Plat of Vacation, attached hereto as Exhibit A and incorporated herein, pursuant to Chapter 65 of the Illinois Compiled Statutes, Section 5/11-91-1, subject to the conditions set forth in Section 3.

 

SECTION 3

 

The property hereby vacated is legally described as follows:

SECTION 4

 

The Village shall cause the Plat of Vacation, attached as Exhibit A to this Ordinance, and a certified copy of this Ordinance to be recorded as required by statute. 

 

SECTION 5

 

All ordinances or parts of ordinances in conflict therewith are to the extent of such conflict hereby repealed and that each section, paragraph, clause and provision of this ordinance is separable and if any provision is held unconstitutional or invalid for any reason, such decision shall not affect the remainder of this Ordinance, nor any part thereof, other than that part affected by such decision.

 

SECTION 6

 

This Ordinance shall be in full force and effect from and after its passage and publication according to law.

 

SECTION 7

 

The Village Clerk is hereby authorized and directed to publish said Ordinance in pamphlet form according to law.
