AN ORDINANCE ASCERTAINING THE PREVAILING RATE OF WAGES FOR LABORERS, MECHANICS AND OTHER WORKERS EMPLOYED ON PUBLIC WORKS PROJECTS IN THE VILLAGE OF ORLAND PARK

 

Body

WHEREAS, the State of Illinois has enacted the “Prevailing Wage Act", as amended (820 ILCS 130/0.01 et seq.) (the “Act”); and

 

WHEREAS, the aforesaid Act requires that the Village of Orland Park (the “Village”) investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers, in the locality of the Village, employed in performing the construction of public works for the Village;

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

To the extent and as required by the Act, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in the construction of public works coming under the jurisdiction of this Village is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook County area as determined by the Department of Labor of the State of Illinois, as of July 1, 2015, a copy of that determination being attached hereto as EXHIBIT "A" and incorporated herein by reference. The definition of any terms appearing in this Ordinance that are also used in the aforesaid Act shall be the same as in said Act.

 

SECTION 2

 

Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of the Village to the extent required by the aforesaid Act.

 

SECTION 3

 

The Village of Orland Park shall publicly post or keep available for inspection by any interested party in the main office of this Village this determination of such prevailing rate of wages. A copy of this determination or of the current revised determination of prevailing rate of wages in effect shall be attached to all contract specifications prepared by the Village.

 

 

 

 

SECTION 4

 

The Village Clerk shall mail a copy of this determination to any employer, to any association of employers and to any person or association of employees who have filed, or file their name and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates.

 

SECTION 5

 

The Village Clerk shall promptly file a certified copy of this Ordinance with the Department of Labor of the State of Illinois.

 

SECTION 6

 

The Village Clerk shall cause a notice to be published, in a newspaper of general circulation within the Village, that the determination of prevailing wages has been made, within thirty (30) days of the adoption of this Ordinance.  Said notice shall conform substantially to the notice attached hereto as EXHIBIT "B" and incorporated herein by reference.  Such publication shall constitute notice that this is the determination of the Village and that it is effective as of the date of this Ordinance.

 

SECTION 7 

 

In light of the fact that:

 

A.  The Department of Labor of the State of Illinois has not updated its determination, relative to the prevailing rate of wages for construction work in Cook County, since July, 2015;

 

B.  The Department of Labor of the State of Illinois has indicated that it is in the process of updating the prevailing rate of wages for construction work in Cook County for 2017, but has not done so to date; and

 

C.  The Village desires to always have ascertained the prevailing rate of wages for construction work for the Village to be the most recent determination by the Department of Labor of the State of Illinois for Cook County;

 

the Village Clerk is hereby authorized to substitute the most recent determination of the prevailing rate of wages for construction work in Cook County by the Department of Labor of the State of Illinois, if a new determination is made after the adoption of this Ordinance, for EXHIBIT “A” to this Ordinance, prior to the filing of a certified copy of this Ordinance, with the Department of Labor of the State of Illinois, as required by Section 5 of this Ordinance, and any such new determination is hereby approved as a substitute for EXHIBIT “A” hereto, and shall be attached hereto as EXHIBIT “A”.

 

SECTION 8

 

That this Ordinance shall be in full force and effect from and after its adoption as provided by law.
