AN ORDINANCE ANNEXING TERRITORY PURSUANT TO 65 ILCS 5/7-1-8 (17101 WOLF ROAD)
Body
WHEREAS, the Village of Orland Park (“Village”) is a home rule municipal corporation organized and operating under the authority of the Constitution and laws of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the Village’s home rule powers and functions; and
WHEREAS, the owners of record of the property commonly known as 17101 Wolf Road, (PIN No. 27-29-300-034-0000) in unincorporated Cook County, legally described in Exhibit B, attached to this Ordinance, and depicted on the plat of annexation attached to this Ordinance as Exhibit A (“Property”), have filed a duly executed petition for annexation seeking annexation of the Property to the Village, attached to this Ordinance as Exhibit C (“Annexation Petition”); and
WHEREAS, the Property is contiguous to the corporate limits of the Village and is not within the corporate limits of any municipality; and
WHEREAS, there are no electors residing on the Property; and
WHEREAS, notice of the annexation has been delivered to all entities and officials as required by Section 7-1-1 of the Illinois Municipal Code, 65 ILCS 5/7-1-1; and
WHEREAS, the Village desires to have the Property annexed to the Village pursuant to Section 7-1-8 of the Illinois Municipal Code; and
WHEREAS, the President and Board of Trustees of the Village of Orland Park have found and determined that it is in the best interests of the Village that the Property be annexed to the Village.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
The President and Board of Trustees adopt the foregoing recitals as though fully set forth therein. All Exhibits to this Ordinance are incorporated herein by this reference.
SECTION 2
Pursuant to 65 ILCS 5/7-1-8, the Property legally described in Exhibit B and depicted in Exhibit A is hereby annexed to the Village of Orland Park.
SECTION 3
The Village Administrator is hereby authorized and directed to:
A. record in the office of the Cook County Recorder of Deeds, promptly after the approval of this Ordinance, a certified copy of this Ordinance, including the Plat of Annexation, and the affidavits of service as required by law; and
B. notify the election authorities, as defined in Section 7-1-1 of the Illinois Municipal Code, the Illinois Department of Transportation, and the U.S. postal service branch serving the Property, of the annexation by certified or registered mail within 30 days after the effective date of this Ordinance.
SECTION 4
That all ordinances and resolutions, or parts thereof, in conflict with the provisions of this Ordinance are, to the extent of such conflict, superseded by this Ordinance.
SECTION 5
This Ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form, if required by law.
