PROJECT DESCRIPTION & CONTEXT

The petitioner proposes to install a new fence and additional landscape screening along the south property line of a motor vehicle services facility outdoor storage area located at 11351 183rd Street.

The proposed fence, located along the rear right-of-way line, is an 8-foot tall white PVC Estate Privacy model manufactured by Merchants Metals. This fence complies with the general requirements, including being accessory to the primary use and not obstructing public use of the street, sidewalk, or right-of-way. The fence will have a minimum clearance of 3 inches from grade to the bottom, and the finished side will face the street and neighboring properties. It is not constructed in a manner that would endanger persons climbing on or over it. Additionally, as it is located in a non-residential district, the fence is permitted to be solid and does not exceed the 8-foot height limit.

The landscape plan includes the installation of various plantings by 1st Choice Lawn Service. The specific plantings include 36 Happy Return Daylilies (1-gallon size), 10 Red Twigged Dogwoods (7-gallon size), 32 Arrowwood Viburnums (5-gallon size), 15 Green Giant Arborvitae (7 feet tall), and 19 Serbian Spruces (7 feet tall).

6-104.F Obstruction of Public Right of Way of the Land Development Code (LDC) states that except as otherwise permitted by these regulations, no structure, fence, landscaping, driveway, parking lot, newspaper vending machine or mailbox shall be permitted which obstructs or otherwise interferes with public use of a street right-of-way or other public easement.

Section 6-310.C.5 states that no fence shall be constructed in such a manner as to impede or alter the natural surface water drainage of the property upon which the fence is constructed or any adjoining property. As the topography along the property lines where the fence is proposed is uneven, care should be taken to ensure the proposed fence does not alter existing water drainage.

Overall, the project conforms to the Village’s Comprehensive Plan, Land Development Codes and policies for this area.
