HISTORY

This office building is part of the Crystal Professional Center Planned Development. The development was first approved in 1993 via Ordinance No. 1647 to allow the construction of an office building. An amendment to the special use permit ordinance was granted a couple of months later to allow the construction of an additional office building on the same lot (Ordinance No. 2385).

Vital Care is a new non-retail specialty pharmacy proposing to occupy the vacant tenant space at 14315 108th Avenue, Unit 110. Vital Care prepares and administers infusion therapies, also known as Ambulatory Infusion Site (AIS) healthcare.

DETAILED PLANNING DISCUSSION

The petitioner is proposing to install a new condenser unit on the exterior of the building, within an existing window well. Vital Care requires the new condenser unit in order to perform their daily business activities. Their floor plan includes a new “clean room” and drug storage room, both of which require controlled temperatures. A clean room in a pharmacy setting is a controlled environment designed to maintain sterility and prevent contamination during the preparation and manufacture of pharmaceutical products.

Section 6-302.C.1 of the Land Development Code (LDC) states that air conditioning may project into all rear setbacks and may project into a side yard if it is not within a required setback. The location of the condenser unit is within a side yard, but not the required setback. Furthermore, Section 6-308.J of the LDC states that ground-based mechanical equipment shall be fully screened from public view by the use of walls, fencing, landscaping, or a combination of measures. The proposed location is also within a window well on the exterior of the building. Due to the change in grade, this window well is partially underground and fully screened from public view. There is also landscaping within the window well as an additional method of screening.

Overall, the project conforms to the Village’s Comprehensive Plan, Land Development Codes, and policies for this area.
