REQUESTED ACTION:

Appearance Review approval is requested to convert the facades of the former Boston Market Restaurant to a Wendy’s Restaurant.

TRANSPORTATION:

The site is accessible from two points on a shared drive aisle to the west of the site that connects to 159th Street to the south and to Goodwill Industries to the north.

 

PLANNING OVERVIEW AND DISCUSSION:

The petitioner proposes to convert the former Boston Market on 159th Street into a Wendy’s Restaurant.  The building has been vacant for almost two years.

 

The existing brick building structure will remain, and the brick base of the building will remain as is.  The upper façade will be replaced with a Wendy’s style façade that includes a new red metal awning and rooftop arch, new stone facade ‘piers’ on the front corners of the building, door and window relocations on the east facade, and new white aluminum trim. One supplied rendering shows stone piers on the east elevation, extending from the ground to the red archway.  This is the preferred elevation, rather than the EIFS shown on the submitted elevations.

 

Four wall mounted lights are proposed on each front building corner.  Fixtures should meet all Code requirements. "Copper Light Band" is proposed around the building, but is not permitted by the Land Development Code.

 

Sign permits are required for any new signage, and it is noted that the “Quality is Our Recipe” signage will not be permitted.

 

The western acess drive is in need of some asphalt repair.  It is unclear who is responsible for maintenance.

 

A revised Final Landscape Plan was approved by the Village Board on December 20, 2010 that will include the removal of twenty-four of the shade trees, but the addition of many shrubs and perennials.  Although the parkway trees along the western drive parkway that are proposed for removal were installed by Boston Market, and are located along an access easement, permission to remove them should be verified.

 

The petitioner is now requesting a revised Appearance Review approval that reflects the following changes to the existing site, proposed Elevations, and proposed Landscape Plan:

 

1. The parking lot circulation was changed to one way and parking spaces repainted at an angle, along with some planting island changes to support the one way circulation.

2. Handicapped ramps were added to the site.

3.  A new, larger outdoor cooler was added to rear of the building.  A matching brick enclosure for the new cooler is reflected on the revised Elevations.  The Elevations have also been updated to reflect the addition of stone piers on the east building elevation and the labelling of the copper accent band as non-illuminated,  both required conditions  on the originally approved Appearance Review.

4. Since the surveyed location of the property line was incorrect on the originally approved plans, another revised Landscape Plan relocated some of the proposed  trees and shrubs to other buffer locations on Wendy's property.  The total number of proposed trees, shrubs, and groundcover was not reduced from the originally Board approved numbers, and some perennials were added.

 

Recommended Action/Motion

The Appearance Review petition for case number 2010-0650, for Wendy’s International Inc., as shown on “Exterior Elevations” by Wallin-Gomez Architects, page A-3, job # 10037, dated 4-13-11; and as shown on the revised Site Plan titled "Wendy's Geometric Plan" by Marchis Engineering job # 11-014 page CE-3, dated 2.16.11, revised 4-12-11;and as shown on the revised Landscape Plan titled "Wendy's Landscape Plan" prepared by Countryside Landscape Architects and Contractors, job number 11-014, dated 2-16-11, revised 4-12-11, and as revised again on May, 18, 2011 to add another parking space at the southeast corner of the building row of parking as shown on exhibit submitted to the Village on May 16, 2011, has been approved administratively on May 18, 2011, subject to the following conditions:

1) Change the two parking spaces shown as perpendicular in the southeast corner of the parking lot to one angled space that aligns with the other repainted angled spaces, and change the curb line to expand the planting bed and support  that revised configuration.

2) Submit the $13,600 tree mitigation fee required by the Board approved Landscape Plan prior to the issuance of building permits.

3) Verify the terms and conditions of Wendy’s western access easement along driveway:  a) Work with neighbor to repair potholes on access drive.   b) Verify permissions to remove western drive parkway trees.

4) Obtain sign permits for the review and approval of all signage.

5) Screen any new visible mechanical units on the rooftop or ground.

6) Do not install new electrical conduits on the exterior walls.

7) Meet all building code requirements and obtain all required building permits.

8) Green planting islands are added adjacent to the additional parking space at the southeast corner of the building row of parking and on the opposite side of the lot, as shown on exhibit submitted to the Village on May 16, 2011.

9) Any plant material displaced by the new parking space will be relocated elsewhere on the site.

 

UPDATE:  On June 15, 2011, three existing borer infested Ash Trees (T9, T1, T33, T30) were removed and replaced with 4" Thornless HoneyLocust.
