AN ORDINANCE AMENDING CHAPTER 3 OF TITLE 7 OF THE VILLAGE OF ORLAND PARK MUNICIPAL CODE REGARDING BILLIARD PARLOR OPERATOR'S LICENSES

WHEREAS, the Village of Orland Park, Cook and Will Counties, Illinois (the “Village”) is a home rule municipality organized and operating pursuant to Section 6(a), Article VII of the 1970 Constitution of the State of Illinois, and as such may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the Illinois Municipal Code authorizes the Village’s corporate authorities (65 ILCS 5/11-42-2) to license, regulate, or prohibit billiard and pool tables; and
WHEREAS, Chapter 3, Title 7 of the Village of Orland Park Municipal Code (“Village Code”) regulates the Village’s Billiard Parlor Operator's licenses; and
WHEREAS, the Corporate Authorities desire to amend Chapter 3, Title 7 of the Village Code to regulate the establishments eligible for Billiard Parlor Operator's licenses; and
WHEREAS, the Village Board finds that it is desirable and in the best interests of the Village and its residents to approve this Ordinance to further regulate Village-issued Billiard Parlor Operator's licenses.
NOW, THEREFORE, BE IT ORDAINED by the Village President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois:
SECTION 1
That the above recitals and legislative findings are found to be true and correct and are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.
SECTION 2
Village Code amended. Title 7, Chapter 3, Section 7-3-11-1 of the Village of Orland Park Village Code is hereby in part (additions in bold and underlined, deletions struck-through, omitted language is not intended to be amended) as reflected and attached hereto as EXHIBIT “A”.
SECTION 3
All ordinances, resolutions, motions or other actions in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 4
If any part of this Ordinance is found or determined to be invalid, the invalid portion shall be stricken here from and the remainder shall be in full force and effect.
SECTION 5
This Ordinance shall be in full force and effect upon its passage and publication in pamphlet form, in accordance with law, and the provisions of the Village of Orland Park’s Code of Ordinances amended herein shall be reprinted with the changes.
