AN ORDINANCE ANNEXING TERRITORY PURSUANT TO 65 ILCS 5/7-1-13 (15601 S. 108TH AVE; 15605 S. 108TH AVE)

 

Body

 

                     WHEREAS, the Village of Orland Park (“Village”) is a home rule municipal corporation organized and operating under the authority of the Constitution and laws of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the Village’s home rule powers and functions; and

 

                     WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, 65 ILCS 5/7-1-13, the Village has the authority to annex unincorporated territory consisting of 60 acres or less that it is wholly bounded by one or more municipalities; and

 

                     WHEREAS, the Village desires to annex the territory commonly known as 15601 S. 108th Ave and 15605 S. 108th Ave in unincorporated Cook County, consisting of approximately 0.52 acres in area, legally described in Exhibit A, attached to this Ordinance, and depicted on the plat of annexation attached to this Ordinance as Exhibit B (“Property”); and

 

                     WHEREAS, the Property contains less than 60 acres, is wholly surrounded by the Village, is contiguous to the corporate limits of the Village, and is not within the corporate limits of any municipality; and

 

                     WHEREAS, on January 2, 2026, written notice of the Village’s intention to annex the Property was served by certified mail on the taxpayers of record of the Property as appears from the authentic tax records of Cook County (65 ILCS 5/7-1-13); and

 

                     WHEREAS, on January 9, 2026, notice of the Village’s intention to annex the Property was duly published in the Daily Southtown, a newspaper of general circulation within the Property to be annexed (65 ILCS 5/7-1-13); and

 

                     WHEREAS, written notice of the Village’s intention to annex the Property has been delivered to all persons, entities, and officials required to receive notice of the annexation in accordance with the Illinois Municipal Code (65 ILCS 5/7-1-1; 65 ILCS 5/7-1-13), and an affidavit of service is attached to this Ordinance as Exhibit C; and

 

                     WHEREAS, the President and Board of Trustees of the Village of Orland Park have found and determined that it is in the best interests of the Village that the Property be annexed to the Village.

 

                     NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The President and Board of Trustees adopt the foregoing recitals as though fully set forth therein. All Exhibits to this Ordinance are incorporated herein by this reference.

 

SECTION 2

 

Pursuant to 65 ILCS 5/7-1-13 and all other applicable authority, the Property legally described in Exhibit A and depicted in Exhibit B is hereby annexed to the Village of Orland Park.

 

SECTION 3

 

The Plat of Annexation of the Property, attached as Exhibit B, is hereby approved and found to be an accurate depiction of the Property.

 

SECTION 4

 

The Village Administrator is hereby authorized and directed to:

 

                     A.                     record in the office of the Cook County Recorder of Deeds, promptly after the approval of this Ordinance, a certified copy of this Ordinance, the Plat of Annexation, and the affidavit of service in Exhibit C, as required by law;

 

                     B.                     file in the offices of the Cook County Clerk and election authorities, a copy of this Ordinance, in accordance with Section 7-1-13 of the Illinois Municipal Code; and

 

                     C.                     notify the election authorities, as defined in Section 7-1-1 of the Illinois Municipal Code, the Illinois Department of Transportation, and the U.S. postal service branch serving the Property, of the annexation by certified or registered mail within 30 days after the effective date of this Ordinance.

 

SECTION 5

 

That all ordinances and resolutions, or parts thereof, in conflict with the provisions of this Ordinance, are to the extent of such conflict, superseded by this Ordinance.

 

SECTION 6

 

This Ordinance shall be in full force and effect upon and after the occurrence of the following events:

 

                     (i)                     passage, approval, and publication in pamphlet form, if required by law; and

 

(ii)                     recordation with the Cook County Recorder’s Office of this Ordinance together with all attachments, exhibits, and affidavits of service as required by law.
