DETAILED PLANNING DISCUSSION

The pavilion is about 400 square feet in size and 13’ tall. It will be anchored to a concrete pad to be installed underneath the pavilion. Pavilions are not defined in the Land Development Code, but they are most similar to gazebos which are defined and regulated as accessory structures. All accessory structures must adhere to the regulations in Section 6-213.E, that accessory buildings and structures cannot be placed closer than 5’ from an adjacent property line. The proposed location of the pavilion meets this requirement. Gazebos shall not exceed 15’ in height, or the height of the top of the principal structure of the parcel on which it is located, whichever is less. There is no principal structure at Helen Park, therefore, the proposed height of 13’ meets code requirements.

Overall, the proposed work meets the intent of the Village Comprehensive Plan.
