AN ORDINANCE AMENDING TITLE 1, CHAPTER 14 OF THE ORLAND PARK VILLAGE CODE IN REGARD TO THE ASSESSMENT OF ADMINISTRATIVE COSTS AND, WHERE APPROPRIATE, ORDER RESTITUTION OF THE VILLAGE BY THE ADMINISTRATIVE HEARING OFFICER

Body
WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and protect the public health, safety, and welfare of its citizens; and

WHEREAS, pursuant to 65 ILCS 5/1-2-1, the Village may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities; and

WHEREAS, the Village deems it to be in the best interest of the public to recover administrative hearing costs and restitution of the Village for damage suffered by the Village from those found liable by the administrative hearing officer.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, and pursuant to its home rule powers, as follows:

SECTION 1

The above recitals are incorporated herein by reference as though fully set forth herein.

SECTION 2

Title 1, Chapter 14, Section 2.A.7 and 2.A.8, of the Orland Park Village Code is amended in their entirety to provide as follows:

1-14-2: ADMINISTRATIVE COMPOSITION:

A. Powers of the Hearing Officer…

“7. Issue a determination, based on the evidence presented at the hearing, of whether a Village Code violation exists. The determination shall be in writing and shall include a written finding of fact, decision, and order setting forth the fine, penalty, restitution of the Village for any damage suffered by the Village, or any other action with which the person found liable must comply.
8. Impose penalties consistent with applicable Village Code provisions and assess administrative costs in the amount of FIFTY DOLLARS ($50....
