History
This ordinance modernizes the Village’s civil emergency and minor curfew regulations to better protect public safety during emergencies and clarify parental responsibility. It updates definitions, procedures, and penalties to reflect current societal needs.
The following summarizes the proposed ordinance:
Civil Emergency Declaration - The Mayor and Chief of Police may declare a civil emergency when riots, unlawful assemblies, disasters, or large disturbances threaten public safety. The declaration must be made in writing and cannot suspend constitutional rights.
Public Notice - Emergency declarations are communicated immediately via Village social media, website, local news, and direct communication to police for enforcement.
Curfew Orders - The Mayor may establish curfews for all residents or specifically for minors during emergencies. Exceptions apply for those traveling to/from work, school, religious or civil activities, experiencing/responding to emergencies, or as directed by police.
Curfew for Minors - Updates the definition of “minor” to under 18 years of age. Sets curfew hours for minors and outlines exceptions (accompanied by parent/guardian, work, etc.).
Police Enforcement - Police are responsible for enforcing emergency orders and curfews, using the least restrictive means necessary. Violations may result in citations for minors and their parents/guardians.
Parental Responsibility - Parents and legal guardians must take reasonable steps to prevent minors from violating emergency orders or curfews. They are required to appear at court hearings if their child is charged with a violation.
