Ordinance Amending Title 7, Chapter 5 - Solicitors and Street Solicitation
History
In April 2026, the Village Board adopted Ordinance 2026-0372, which amended the Village Code to prohibit pedestrian activity within public roadways, including conduct associated with solicitation activities. The purpose of that ordinance was to enhance public safety by reducing conflicts between pedestrians and vehicular traffic.
Following adoption of Ordinance 2026-0372, the Village conducted a further review of the Code and identified existing provisions within Title 7, Chapter 5 that continued to authorize and regulate charitable street solicitation activities at signalized intersections. These provisions have been determined to be inconsistent with the intent and regulatory framework established by Ordinance 2026-0372 and create potential ambiguity regarding the enforcement of roadway safety regulations.
This proposed ordinance repeals Sections 7-5-13 through 7-5-13-11 of the Village Code, which currently establishes the Village's street solicitation permit program. This repeal eliminates all provisions that authorize charitable organizations to solicit donations from occupants of stopped vehicles at intersections. By eliminating these provisions, the ordinance aligns the solicitation regulations with the Village's existing prohibition on pedestrian activity within public roadways, provides greater consistency throughout the Code, and supports the public safety objectives adopted by the Village Board in Ordinance 2026-0372.
