History
The ordinance updates the Village’s business license regulations to provide greater flexibility and fairness in suspending or revoking business licenses. It aims to protect public health, safety, and welfare by ensuring businesses comply with all applicable laws and regulations. The ordinance gives the Village more discretion to address serious or recurring violations, ensures corrective actions are completed before businesses reopen, and promotes accountability and compliance.
Flexible Suspension Periods:
The Village Manager may suspend a business license for as long as necessary, based on the severity of the violation, the time needed to correct issues, the business’s compliance history, and the need to deter future violations. Licenses may remain suspended until problems are satisfactorily corrected.
Grounds for Suspension or Revocation:
Licenses may be suspended or revoked for reasons including fraud, violations of laws or ordinances, felony or relevant misdemeanor convictions, failure to pay fees or fines, refusal to permit inspections, or conduct that threatens public health or safety.
Immediate Closure:
If a business poses a clear and present danger, the Village can order immediate closure until the danger is resolved. A hearing must be held within eight days to determine if the license should be revoked.
Hearing Process:
The Village will provide written notice of hearings, allow the licensee to present evidence and cross-examine witnesses, and permit legal counsel. The Village Manager serves as hearing officer and decides the outcome, which may include suspension, revocation, fines, or corrective actions.
Appeal Rights:
