AN ORDINANCE AMENDING TITLE 7, CHAPTER 15 OF THE ORLAND PARK VILLAGE CODE IN REGARD TO THE PURCHASE OR POSSESSION OF TOBACCO OR ALTERNATIVE NICOTINE PRODUCTS
Body
WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and protect the public health, safety, and welfare of its citizens; and
WHEREAS, pursuant to 65 ILCS 5/1-2-1, the Village may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities; and
WHEREAS, the Village deems it to be in the best interest of the public to conform to Illinois statutes regarding the purchase or possession of tobacco or alternative nicotine products.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, and pursuant to its home rule powers, as follows:
SECTION 1
The above recitals are incorporated herein by reference as though fully set forth herein.
SECTION 2
Title 7, Chapter 15, Sections 7-15-7 and 7-15-8, of the Orland Park Village Code are amended in their entirety to provide as follows:
“7-15-7: PURCHASE BY PERSONS UNDER AGE 21 PROHIBITED:
It shall be unlawful for any person under the age of twenty-one (21) years to purchase tobacco or alternative nicotine products, or to misrepresent his or her identity or age, or to use any false or altered identification for the purpose of purchasing tobacco or alternative nicotine products.
7-15-8: POSSESSION BY PERSONS UNDER AGE 21 PROHIBITED:
It shall be unlawful for any person under the age of twenty-one (21) years to possess tobacco or alternative nicotine products; provided that the possession by a person under the age of twenty-one (21) years under the direct supervision of the parent or guardian of such person in the privacy of the parent’...
