AN ORDINANCE AMENDING TITLE 9, CHAPTER 15, SECTION 9-15-13 OF THE ORLAND PARK VILLAGE CODE: (DEBT TO MUNICIPALITY)

Body
WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and to protect the public health, safety and welfare of its citizens; and

WHEREAS, the Village deems it necessary and appropriate to provide for the collection by the Village of a fine or penalty assessed following the seizure and/or impoundment of motor vehicles; and

WHEREAS, it is determined that the Village Code amendment set forth below is in the best interests of the Village and its residents.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

SECTION 1

Title 9, Chapter, 15, Section 9-15-13, of the Village Code is hereby amended in its entirety to provide as follows:

9-15-13: DEBT TO MUNICIPALITY:

“Any fine, penalty or part of any fine or any penalty assessed in accordance with the provisions of this Chapter or assessed in accordance with the provisions of Chapter 10 of Title 6 (Seizure and Impoundment of Motor Vehicles) of this Code, and remaining unpaid after the exhaustion of, or the failure to exhaust, administrative remedies created under this Chapter and Chapter 10 of Title 6 and the conclusion of any judicial review procedures shall be a debt due and owing the Municipality and, as such, may be collected in accordance with the applicable law. Payment in full of any fine or penalty resulting from a standing, parking, or compliance violation shall constitute a final disposition of that violation.
