AN ORDINANCE AMENDING TITLE 6, CHAPTER 2, OF THE ORLAND PARK VILLAGE CODE BY REPEALING SECTION 6-2-2-13 (SMALL UNMANNED AIRCRAFT) AND RELATED PROVISION IN APPENDIX B: FINE SCHEDULE

WHEREAS, Section 6-2-2-13 of the Orland Park Code declares it a public nuisance when individuals operate unmanned aircraft in violation of the regulations and provisions of said Section 6-2-2-13; and
WHEREAS, Illinois Public Act 100-735 amending the Illinois Aeronautics Act became effective August 3, 2018, which Public Act provides in part:
“No unit of local government (home rule and non-home rule), may enact an ordinance or resolution to regulate unmanned aircraft systems.”
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
The above recitals are incorporated herein by reference as though fully set forth herein.
SECTION 2
Section 6-2-2-13 of Title 6, Chapter 2 of the Orland Park Village Code be and hereby is repealed. In addition, APPENDIX B: FINE SCHEDULE of the Village Code be and hereby is amended by repealing all monetary fines established for violations of said Section 6-2-2-13 of Title 6, Chapter 2 of the Village Code.
SECTION 3
This Ordinance shall be in full force and effect from and after its adoption, and publication in pamphlet form as provided by law.
