RESOLUTION WAIVING REQUIREMENT OF COMPETITIVE BIDS AND AWARDING CONTRACT FOR MAINTENANCE AND RECONSTRUCTION OF VARIOUS VILLAGE ROADWAYS AND STREETS TO AUSTIN-TYLER CONSTRUCTION, INC. (2019 NEIGHBORHOOD ROAD IMPROVEMENT PROGRAM - PHASE 2)

Body

WHEREAS, the Village of Orland Park (“Village”) has annually embarked on a road improvement program to maintain and reconstruct Village roadways and streets based upon a schedule established in coordination with the village’s pavement management consultant.; and

 

WHEREAS, following receipt of competitive bids, the Village did, on May 6, 2019, authorize and approve a contract with Austin-Tyler Construction, Inc., the lowest responsible bidder for maintenance and reconstruction of certain Village roadways and streets in accordance with the 2019 Neighborhood Road Improvement Program - 2019 (“Program”); and

 

WHEREAS, the Village President and Board of Trustees have determined that additional Village roadways and streets as hereinafter identified are in need of repair and reconstruction and that the Program should be expanded to Phase 2 as a separate road maintenance and reconstruction project; and

 

WHEREAS, on May 28, 2019, Austin-Tyler submitted a proposal to contract with the Village to undertake and complete the Phase 2 portion of the Program utilizing the same unit pricing as set forth in the contract for the first phase of the Program work approved by the Village President and Board of Trustees on May 6, 2019; and

 

WHEREAS, the Village President and Board of Trustees have determined that it would be more cost effective, more timely and in the best interests of the Village to award a contract to Austin-Tyler Construction, Inc. for Phase 2 of the 2019 Neighborhood Road Improvement Program based on Austin-Tyler’s proposal of May 28, 2019, and pursuant to the powers and authority of the Village as a home rule municipality to waive any requirements for competitive bids for such work as to do so would result in the work having to be delayed until the 2020 road construction season and, in addition, result in higher prices for such work.

 

NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

Phase 2 of the 2019 Neighborhood Road Improvement Program, consisting of the maintenance and reconstruction of the following Village subdivision roadways and streets:

 

                     Brentwood (north half); Arbor Point (including Grandview Drive); Golfview Condos                      (Brassie, Fox Bend, Deerfield and Sunset Ridge Courts); Persimmon Ridge/Persimmon Glen/Persimmon Meadows/Ashford Estates; Seton Place and Tee Brook Villa

 

is hereby approved.

 

SECTION 2

 

Pursuant to the Village’s power and authority as a home rule municipality under the 1971 Illinois Constitution, any requirements for competitive bids under Section 8-9-1 of the Illinois Municipal Code (65 ILCS 5/8-9-1) be and are hereby waived for the 2019 Neighborhood Road Improvement Program Phase 2, as are any and all requirements set forth in Section 1-10-3 of the Orland Park Municipal Code.

 

SECTION 3

 

The May 28, 2019, proposal to the Village by Austin-Tyler Construction, Inc. for Phase 2 of the Program in the amount of $3,532,349.08 is accepted by the Village and a contract is awarded to Austin-Tyler Construction, Inc. in said amount for such work.

 

SECTION 4

 

This Resolution shall be in full force and effect upon its adoption.
