AN ORDINANCE AMENDING TITLE 7, CHAPTER 4 SECTION 7-4-6 (7) OF THE ORLAND PARK VILLAGE CODE IN REGARD TO CLASS G AND CLASS G-5 LIQUOR LICENSE

 

Body

 

WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and protect the public health, safety, and welfare of its citizens; and

 

WHEREAS, pursuant to 65 ILCS 5/1-2-1, the Village may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities; and

 

WHEREAS, the Village deems it to be in the best interest of the public to amend the Village Code provision with respect to liquor licenses for events conducted on the Orland Park Civic Center premises.

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, and pursuant to its home rule powers, as follows:

 

SECTION 1

 

The above recitals are incorporated herein by reference as though fully set forth herein.

 

SECTION 2

 

Title 7, Chapter 4, Section 7-4-6 (7), of the Orland Park Village Code is amended in its entirety to provide as follows:

 

“7. Class G License: Civic Center License:

 

A Class G annual license shall entitle the licensee (the Village or its employees or agents), to make sales of alcoholic liquor at retail for consumption by the drink only on the premises owned by the Village which premises are known and designated as the Orland Park Civic Center, provided that the Village shall provide or cause to be provided dram shop liability insurance coverage in an amount not less than two million dollars ($2,000,000.00) per occurrence so as to save and hold harmless the Village from financial loss, damage or harm arising from the activities pursuant to the Class G Civic Center license.  The Village shall at all times comply with the provisions of Section of 4-1 of the said Illinois Liquor Control Act.  There shall be no fee for an annual Class G Civic Center license and no more than one (1) Class G license shall be issued for a licensed year and be in force and effect at any one time.

 

7.5 Class G-5 License: Temporary Civic Center License:

 

A Class G-5 Temporary Civic Center one (1) day license may also be issued to entitle the licensee to conduct a private (family and/or invited guest) event on the Civic Center premises at which event alcoholic liquor will be served and consumed on the Civic Center premises.  No more than one (1) Temporary Class G-5 for this one (1) day license shall be issued for each of the two (2) separate and distinct rooms within the Civic Center.  There shall be no fee for this Temporary Class G-5 one (1) day license.

 

A Class G-5 Temporary Civic Center licensee shall provide or cause to be provided comprehensive general liability insurance coverage in an amount of not less than two hundred fifty thousand dollars ($250,000.00) for bodily injury and property damage per person and per occurrence and dram shop liability insurance coverage in an amount not less than two hundred fifty thousand dollars ($250,000.00) per occurrence, or not less than one million ($1,000,000.00) per occurrence if a vendor or caterer is employed, so as to save and hold harmless the Village from financial loss, damage or harm arising from the activities pursuant to a Class G-5 Temporary Civic Center license.”

                     

SECTION 3

 

This Ordinance shall be in full force and effect from and after its adoption and publication in pamphlet form as provided by law.
